Uninsured & Underinsured Motorist Claims
OCEAN SPRINGS CAR ACCIDENT LAWYER
With the high incidence of auto accidents, and the ever increasing rate of distracted driving crashes, it’s important now more than ever before to carry uninsured motorist coverage. While most of us do our very best to abide by the state’s laws and carry the state-mandated liability coverage, there are a number of drivers in Mississippi who don’t follow the law and fail to purchase auto insurance.
Unfortunately, most of these uninsured drivers don’t carry insurance because they can’t afford it or because they don’t have valid driver’s licenses to begin with. The best thing you can do to protect yourself and your family from uninsured drivers is to purchase uninsured or underinsured (UM/UIM) motorist coverage from your own insurance carrier. If your insurance agent told you that you have full coverage, it’s important to take a second look to make sure you have UM/UIM coverage on your policy.

Mississippi law requires that all drivers purchase UM/UIM coverage unless they specifically reject it in writing. The minimum limits allowed by law are $25,000 per person/$50,000per accident; however, you can purchase limits up to $500,000 per person/$1,000,000 per accident. Mississippi Code §83-11-101 permits the insured to reject UM coverage in its entirety, or to only reject the property damage portion of the UM coverage.
In Mississippi, if you have more than one vehicle in your household with UM/UIM coverage, you can stack the coverage. For example, if you have three vehicles in your household with UM/UIM coverage in the amount of $25,000 per person/$50,000 per accident, then if a member of your household is injured at the hands of an uninsured driver, you are allowed to “stack” these policies so that the available coverage is now $75,000 per person/$150,000 per accident.
