Workers Compensation Law – Physical Medicine in Mississippi

My workers’ compensation client did not know better. He consented to treatment with one of the most conservative physical medicine doctors in Mississippi who is a darling of the insurance companies. Not surprisingly, even though my client still suffered from back pain and numbness in his leg, the doctor said my client had a 0% disability rating and needed no future medical treatment. After being hired on this case I filed a motion for an independent medical exam. A hearing was held in which a judge heard arguments from me and the lawyer for the insurance company. Opposing counsel argued that my client should not be afforded another evaluation. The judge eventually ruled that my client should get a medical evaluation, paid for by the insurance company, with a neutral orthopedic surgeon selected by the judge. This is the first step towards achieving justice for this client, but it is an important step.
